Terms of Service

Please read these Terms of Service carefully before using LendFlowPro. These Terms constitute a legally binding agreement between you and LendFlowPro, Inc.
1. Acceptance of Terms
By accessing or using LendFlowPro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
LendFlowPro provides AI-powered mortgage processing automation software including document classification, workflow management, borrower communication tools, and integrations with third-party services. The Service is made available on a subscription basis as described on our pricing page.
3. Accounts and Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Payment
Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in service suspension. Annual subscriptions receive a 20% discount as stated on our pricing page.
5. Acceptable Use
You agree to use the Service only for lawful purposes in connection with mortgage processing and related financial services activities. You may not use the Service to violate any applicable laws or regulations, including but not limited to the Gramm-Leach-Bliley Act (GLBA), Fair Credit Reporting Act (FCRA), or Equal Credit Opportunity Act (ECOA). You may not attempt to reverse engineer, decompile, or otherwise extract the source code of the Service.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you upload to the Service. You grant LendFlowPro a limited license to process your data solely to provide the Service. We will not sell or share your data with third parties except as necessary to operate the Service or as required by law.
7. Confidentiality
Each party agrees to keep confidential all non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and circumstances of disclosure. This obligation does not apply to information that is publicly known, independently developed, or required to be disclosed by law.
8. Intellectual Property
LendFlowPro retains all rights, title, and interest in and to the Service, including all intellectual property rights. These Terms do not grant you any rights to use LendFlowPro trademarks, logos, or brand features. Any feedback or suggestions you provide regarding the Service may be used by LendFlowPro without restriction or compensation.
9. Uptime and Service Level
LendFlowPro targets 99.9% monthly uptime for all paid plans. Scheduled maintenance windows will be announced in advance. In the event of an outage that falls below our SLA, eligible customers may request service credits as described in their plan documentation. Service credits are the sole remedy for downtime.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDFLOWPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. LENDFLOWPRO'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LENDFLOWPRO DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
12. Termination
Either party may terminate these Terms at any time. You may terminate by canceling your subscription through the account settings. We may terminate or suspend your access immediately if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination to allow for export, after which it will be permanently deleted.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
